no trick or treating here... :-(

The latest ruling (per my last post) was from the Appellate Court 2 to 1 not in my favour regarding a Guardium Ad Litem for Liam. Our attorneys thought long and hard and decided in Liam's best interest, they needed to file a motion for an En Banc review.

Basically, this means they have asked ALL appellate judges to review the motion (simply meaning the remaining 6 of 9 appellate judges review and give their verdict). Mr Kornreich explained that this is granted only in the most important cases and for the most part, quickly denied. However, it is to show the court how serious we are, especially in the event after the hearing if we do not prevail and need to return to the Appellate Court.

The hearing in the lower court now is scheduled for February 2011.

It's Halloween and we miss not being able to share this fun time in Liam's life. Here's a photo of the costume we made for him 2 years ago--he was a pilot in an airplane wearing parts of my old Air Force uniforms and wings & propeller that Craig made for him. Definitely miss that laughter, joy, and all that wonder in his eyes.
