Still no word. Spoke with my attorney. Basically, even though we've made telephone inquiries to the judge's office, there has been no word or indication of a decision being made any time soon. We've hit 60 days and unfortunately, there is nothing we can do to have the judge make a decision. We are part of an over-worked system; too many cases and not enough time or people to go through everything quickly.
While it seems easy for me to understand--that this specific case cannot be awarded Summary Judgment because you need to get to an Evidentiary Hearing to discover all the facts that pertain to this case, there are laws that I have yet to understand and figure out how it effects us.
I still cannot see how our case is anything like the case cited in Summary Judgement based purely on the fact that I NEVER waived my rights as Liam's father. I NEVER agreed to be solely a "donor." In the case they use to claim Summary Judgement, the father did have a contract with the mother, BUT he did waive his rights.
If the judge has not made a decision by next Thursday, 28 May, then I will ask my attorney to formally (in writing) request the status of this case.
